These Terms of Service ("Terms") govern your access to and use of Cronaut (the "Service") available at https://cronaut.dev. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Cronaut is operated by an independent entrepreneur (auto-entrepreneur) established in France, registered under SIREN 902 134 063 ("Cronaut", "we", "us" or "our"). You can contact us at ghassane@cronaut.dev.
1. The Service
Cronaut provides uptime monitoring, cron and heartbeat monitoring, alerting and public status pages. We may add, change or remove features at any time. We may also set reasonable limits on usage (such as number of monitors, check frequency or data retention) depending on your plan.
2. Accounts and eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorised use. You are responsible for the actions of the team members you invite to your workspace.
3. Acceptable use
You agree that you will only use the Service for lawful purposes. You must not:
- monitor, probe or send requests to systems you do not own or are not authorised to monitor;
- use the Service to launch denial-of-service attacks, port scanning, vulnerability scanning or any other intrusive or abusive activity against any target;
- configure check frequencies or volumes intended to overload a target or our infrastructure;
- upload or transmit unlawful, infringing, harmful or malicious content, including through monitor names, status pages or incident messages;
- attempt to gain unauthorised access to, disrupt or reverse engineer the Service;
- resell or provide the Service to third parties except as expressly permitted.
You are solely responsible for the targets you choose to monitor and for ensuring you have the right to monitor them.
4. Plans, billing and refunds
- Plans. We offer a free plan and paid plans. The features and limits of each plan are described on our pricing page.
- Payment. Paid plans are billed in advance on a recurring basis through our third-party payment processor. By subscribing, you authorise us to charge the applicable fees to your selected payment method.
- Renewals. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time, and the cancellation takes effect at the end of the current billing period.
- Taxes. Fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes.
- Refunds. Except where required by applicable law, payments are non-refundable and there are no refunds or credits for partial periods.
- Changes. We may change our prices. We will give you reasonable notice before a price change affects your subscription.
5. Your data and content
You retain ownership of the configuration and content you submit to the Service (your "Content"). You grant us a limited licence to host, process and display your Content as necessary to provide the Service, including rendering the public status pages you choose to publish. You are responsible for your Content and for any information you choose to make public. Our handling of personal data is described in our Privacy Policy.
6. Intellectual property
The Service, including its software, design and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any right in our trademarks or other intellectual property except the limited right to use the Service in accordance with these Terms.
7. Third-party services
The Service integrates with third-party services (for example payment processing, email delivery and the destinations you configure for alerts such as Slack, Discord or webhooks). We are not responsible for third-party services, and your use of them is subject to their own terms.
8. No guarantee of detection or availability
Cronaut is a monitoring aid, not a guarantee.
We do not warrant that the Service will detect every outage or issue, that alerts will always be delivered, that they will be delivered on time, or that the Service will be uninterrupted or error-free. Monitoring depends on factors outside our control, including networks, third-party providers and the targets you monitor. You should not rely on the Service as your sole means of detecting incidents, and you remain responsible for the availability and operation of your own systems. We do not provide any service level agreement unless separately agreed in writing.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Cronaut shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising out of or relating to the Service or any missed, delayed or false alert or undetected outage, even if advised of the possibility of such damages.
Our total aggregate liability for all claims relating to the Service shall not exceed the amount you paid us for the Service in the six months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages and expenses (including reasonable legal fees) arising from your Content, your use of the Service, the targets you monitor, or your breach of these Terms, to the extent permitted by applicable law.
12. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or use the Service in a way that may harm us, other users or third parties. On termination, your right to use the Service ends and we may delete your data in accordance with our Privacy Policy.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take reasonable steps to notify you. Your continued use of the Service after an update means you accept the revised Terms.
14. Governing law and disputes
These Terms are governed by French law, without regard to conflict-of-law rules. Any dispute relating to the Service or these Terms will be subject to the jurisdiction of the competent French courts, subject to any mandatory consumer protection rules that may grant you the right to bring proceedings in your country of residence.
